The meeting was called to order at 8:45 A.M.

Delegate Patterson thanked the attendees for their presence and gave an overview for the discussion.  There were five bills to be discussed.

 

PG 415-03  Commercial Entertainment Zones - Sales Tax on Food and Beverages

 

This bill authorizes the Prince George's County Council to impose and collect a tax on the sale of certain food and beverages in a commercial entertainment zone.

Status:  This bill was placed on Special Hold

 

PG 409-03  Telecommunications Tax - Exemption

 

This bill authorizes rather than require the Prince George's County Council to impose a sales and use tax on certain telecommunications services in Prince George's County at a rate of not less than 5%.

 

Delegate Griffith motioned for withdrawal of this bill;  Delegate Hubbard seconded the motion.

Status:  Unfavorable/Withdrawn (5-0, 2 absent)

 

PG 417-03  Telecommunications Tax - Exemption Based on Age

 

This bill authorizes the Prince George's County Council to exempt services provided to certain classes of persons based on age from the sales and use tax imposed on certain telecommunication services in Prince George's County.

 

Delegate Griffith made a favorable motion for this bill;  Delegate Hubbard seconded the motion.

Status:  Favorable (5-0, 2 absent)

 

PG 414-03  Prince George's County Public School Facilities - Surcharge Increase

 

This bill alters the amount of public school facilities surcharge and authorizes certain municipal corporations in Prince George's County to impose a public school facilities surcharge under certain circumstances and generally relating to the public school facilities surcharge in Prince George's County.

Amendment No. 1:  Increased the school facilities surcharge from $10,000 to $12,000 in fiscal year 2004 and retains the CPI adjustment for fiscal year 2005 and thereafter. The amendment was adopted favorable by Delegate Hubbard and seconded by Delegate Howard.

Status:  Favorable ( 5-0, 2 absent)

 

Amendment No. 2:  Require municipal corporations in the County that have zoning authority and the authority to issue building permits to impose a school facilities surcharge and to remit the school facilities surcharge to the County.  The amendment was adopted favorable by Delegate Hubbard and seconded by Delegate Howard.

Status:  Favorable (5-0, 2 absent)

 

Amendment No. 3:  Impose a threshold for building permits subject to the school facilities surcharge and authorize the imposition of a school adequate public facilities test imposed by County Council ordinance. Delegate Parker had concerns and the amendment was voted unfavorable.

Status:  Unfavorable (5-0, 2 absent)

 

Amendment No. 5: Grandfathers the increase in the school facilities surcharge so as not to apply the school facilities surcharge increase to properties covered by the school.  The amendment was voted unfavorable and withdrawn.

Status:  Unfavorable/Withdrawn (5-0, 2 absent)

 

Amendment No. 6:  Authorizes the County to use the funds for not only capital improvements (including payment of debt service) for expansion of the school capacity but also for payments toward other alternative construction financing.  The amendment was voted unfavorable.

Status:  Unfavorable (5-0, 2 absent)

 

Amendment A:  Authorizes a school faculty surcharge imposed on a single-family detached dwelling, townhouse or dwelling unit for any other building containing more than a single dwelling unit.  The amendment was voted unfavorable.

Status:  Unfavorable (5-0, 2 absent)

 

 

PG 440-03  State Lottery Tickets - Prince George's County Surcharge [PG-418-03]

 

This bill authorizes the County Executive and the County Council to pass an ordinance imposing a surcharge on State lottery tickets purchased in Prince George's County, and requiring the County Executive and County Council to determine the amount of the surcharge to be imposed and to use the revenues raised for specified purposes.  This bill was voted unfavorable.

Status:  Unfavorable (5-0, 2 absent)
